Krohn and Klein persuaded a Buchanan County, MO jury to find in their client’s favor and award a favorable defense verdict to the Defendant who was in a multi car interstate collision.
Plaintiff, Stephanie Binning, brought suit against Defendant, Juanita Sherrow, for damages alleged resulting from multi car collision on Interstate 29 Highway just south of St. Joseph, MO. Ms. Sherrow lost control of her vehicle in a pouring rain as she was overtaking Plaintiffs’s and others’ vehicles. She hit the guardrail on the shoulder causing her vehicle to re-enter the driving lane where it was hit by another vehicle; Ms. Sherrow’s vehicle then continued into the passing lane where it was hit by Plaintiff’s vehicle. Plaintiff parked her mini van in the passing lane of I-29 North. Subsequently, Plaintiff’s vehicle was hit by a tractor-trailer unit owned by Kosch Trucking.
Plaintiff alleged neck, shoulder, back and leg injuries required past and future medical expenses in excess of $7,400. Plaintiff claimed permanent injuries and sought $75,000 in damages. Defendant filed an Offer of Judgment in the amount of $5,000 prior to trial. The jury returned a verdict awarding Plaintiff $12,500, but was assessed 25% of fault to Plaintiff, for a net verdict of $9,375. However, Defendant was entitled to a credit or setoff for monies the trucking company paid in the amount of $12,500. This resulted in a net verdict of zero to be paid by Defendant.
Plaintiff’s expert was Dr. Pradep Narotam, neurosurgeon of Creighton University, Council Bluffs, IA. Defendant’s expert was Dr. Robert Boulware.
